if the End User is not in privity of contract with CAST.
The terms described in (i) or (ii) above are collectively referred to as the "Terms and Conditions."
4. License Grant
CAST grants the applicable End User a non-assignable, non-transferable, non-exclusive right to use the MCP Server at no additional charge for the sole purpose of enabling the permitted use of the Services, as described in the corresponding Order, and strictly in accordance with the applicable Terms and Conditions.
The End User is granted the right to:

• Use the MCP Server independently of an active and valid subscription to the Services;
• Modify, distribute, sublicense, or otherwise exploit the MCP Server beyond the rights expressly granted herein.
All other use, reproduction, modification, distribution, or exploitation of the MCP Server is prohibited.
5. Termination
The grant of use of the MCP Server will be automatically terminated if:
(a) the End User or third parties under its direction and control violate this EULA;
(b) the End User exceeds — or would cause the party who placed the Order to exceed — the scope outlined in the corresponding Order;
(c) the End User violates — or would cause the ordering party to violate — any applicable Terms and Conditions.
In the event of termination, the End User shall immediately cease use of the MCP Server and uninstall or destroy all copies deployed on any infrastructure.

7. Limitation of Liability
In no event shall CAST be liable for any consequential, special, incidental, indirect damages, loss of profits or revenue, loss of use of data, systems, or programs, or costs of recovering data.
