CAST AIP SOFTWARE PROBLEMS CONTEST RULES
THE CAST SOFTWARE PROBLEMS CONTEST (THE "CONTEST") IS INTENDED TO BE CONDUCTED WORLDWIDE AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE FRENCH LAW. NO PURCHASE IS NECESSARY. THE CONTEST IS OPEN TO EMPLOYEES OF ACTIVE CUSTOMERS OF CAST SA AND ITS SUBSIDIARIES AND AFFILIATES (COLLECTIVELY “CAST”) CUSTOMERS ONLY. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE "CONTEST RULES").
To be eligible for this Contest, an individual must
(a) be an employee or consultant of a company considered as an active customer for CAST (customer with an active maintenance or which has been invoiced by CAST in the last 12 months)
(b) have an active CAST customer company email address domain
CAST employees, companies not listed as active CAST customers and emails from domain names different from active CAST customer domain names are not eligible to participate in the Contest. CAST shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to CAST for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. CAST reserves the right, in its sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
2. CONTEST PERIOD
The Contest begins at 6:00 a.m. Central Standard Time ("CST") on June 9th, 2016, and ends at 11:59 p.m. CST on June 30th, 2016 (the "Contest Period") after which time the Contest will be closed and no further entries shall be accepted.
3. HOW THE CONTEST WORKS
(a) entrants have to complete the survey in English
(b) entrants have to submit software problems (“Software Problems”) that the solution CAST Application Intelligence Platform (“CAST AIP”) should detect. Software Problems should be considered in the following sense:
- specific software or architectural quality issues or measurements that reflect any aspects of software quality. For example software flaws, bad coding patterns, or problems in the interaction between different software layers or technologies, or between applications and frameworks, etc.
- impact on any aspect of software quality. For example stability and robustness, performance, efficiency, changeability, transferability, maintainability, security, or any other relevant aspect.
4. HOW TO ENTER THE CONTEST
(a) there is no purchase necessary to enter the Contest.
(b) complete personal contact details ("Personal Information") such as first name, last name, business email address, business card title, company name.
(c) multiple Software Problems entries per person during the Contest Period are allowed. In the case of multiple entries, only one entry will be eligible to win the Prize (see 5(a) ).
(d) accept the contest rules by clicking on the “SUBMIT” button as a part of completing the survey at the link in 3(a) above. By submitting a Software Problem the Entrant accepts that CAST might use or develop the Software Problem, even if the Software Problem does not win the Prize. Software Problems entries will become CAST property if developed by CAST. CAST has no rights in Software Problems that are not developed by CAST.
(e) Software Problems entries must be received no later than the end of the Contest Period. Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced. No communication or correspondence will be exchanged with entrants except with those selected for a Prize.
(f) Software Problems entries received online shall be deemed to be submitted by the authorized account holder of the e- mail address associated with the entry. For the purpose of the Contest Rules, "authorized account holder" of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Each selected entrant may be required to provide CAST with proof that the selected entrant is the authorized account holder of the e-mail address associated with the winning entry.
(a) There are three (3) prizes (the "Prize") available to be won by the Prize winner (the "Winner") consisting of: one (1) iPad mini 4 16Gb,Wi-Fi device valued at approximately Four Hundred Ninety Nine Dollars ($499 USD).
(b) Winner is not entitled to monetary difference between actual Prize value and stated approximate Prize value, if any.
(c) Prizes will be distributed within three (3) weeks after Winner has been successfully contacted and notified of his/her Prize and fulfilled the requirements set out herein. The Prize must be claimed within thirty (30) business days of notification of being selected as a Winner. Failure to claim the Prize within the allotted time period may result in forfeiture of all rights to the Prize (in CAST’s sole discretion).
(d) Prizes must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of CAST. CAST reserves the right, in its and their sole discretion, to substitute a prize of equal or greater value if a Prize (or any portion thereof) cannot be awarded for any reason.
(e) Shipped Prizes shall not be insured and CAST shall not assume any liability for lost, damaged or misdirected Prizes.
6. WINNER SELECTION
Three (3) Winners shall be selected as follows:
(a) On or about August 1st, 2016, three (3) entrants will be selected by a CAST expert committee from all eligible Software Problems entries received during the Contest Period. Each entrant shall be eligible to win only one (1) Prize. Being selected as a potential winner is dependent upon the quality of Software Problems entries received by CAST based on the three (3) criteria below:
- Uniqueness, e.g. to what extent is the suggestion new or inspired by real-world problems
- Business value, e.g. how likely is the suggestion to detect important or common problems in software applications
- Feasibility, e.g. is it possible to identify the problem with a tool like CAST AIP.
(b) THE SELECTED ENTRANT WILL BE NOTIFIED BY E-MAIL NO LATER THAN AUGUST 1st, 2016 AT 5:00 P.M. CST AND MUST RESPOND WITHIN FOUR (4) BUSINESS WEEKS OF NOTIFICATION. Upon notification, the selected entrant must respond by e-mail to the email address provided in the notification, and the selected entrant's response must be received by CAST within two (2) business days of such notification. If the selected entrant does not respond in accordance with the Contest Rules, he/she will be disqualified and will not receive a Prize and another entrant may be selected in CAST’s sole discretion until such time as an entrant satisfies the terms set out herein. CAST is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for CAST to receive a selected entrant's response.
The winners will be required to execute a legal agreement and release ("Release") that confirms Winner's:
- eligibility for the Contest and compliance with these Contest Rules;
- acceptance of the Prize as offered;
- release of each of CAST and its subsidiaries, affiliates and/or related companies and each of their employees, directors, officers, suppliers, agents, sponsors, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively, the "Releases") from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and
- grant to CAST the unrestricted right, in CAST’s collective or individual discretion, to produce, reproduce, publish, broadcast, communicate by any means, exhibit, distribute, adapt and otherwise use or re-use the winning Software Problems entries, in any and all media now known or hereafter devised, in connection with the Contest and the promotion and exploitation thereof. The executed Release must be returned within two (2) business days of the verification as a Winner or the selected entrants will be disqualified and the Prize will be forfeited.
8. LIMITATION OF LIABILITY
CAST assumes no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or any Release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. CAST is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. CAST assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. CAST is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. CAST is not responsible for any injury or damage to entrant or to any computer related to or resulting from participating or downloading materials in this Contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any Prize. CAST assumes no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of CAST, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Contest, the Contest Website.

10. PRIVACY/USE OF PERSONAL INFORMATION
(a) By participating in the Contest, entrant: grants to CAST the right to use his/her name, mailing address, telephone number, and e-mail address ("Personal Information") for the purpose of administering the Contest,
(b) CAST will use the entrant's Personal Information only for identified purposes, and protect the entrant's Personal Information in a manner that is consistent with the French Law on computers, files and liberties dated January 6, 1978, amended in 2004,
(c) In compliance with the French Law on computers, files and liberties dated January 6, 1978, amended in 2004, entrants have the right to access and rectify information concerning you that you can exercise by writing to us at the following address: CAST Legal, 3 rue Marcel Allégot 92190 Meudon, France.
11. INTELLECTUAL PROPERTY
All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by CAST. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
CAST reserves the right, in their sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest, and/or the Contest Rules in any way, at any time, for any reason without prior notice.
These are the official Contest Rules. The Contest is subject to applicable French and European law. The Contest Rules are subject to change without notice in order to comply with any applicable laws or the policy of any other entity having jurisdiction over CAST.
